- How the Program Works: Membership & Eligibility
2.0 For a purchase to qualify under the Program, the customer must be (i) a natural person, (ii) enrolled in the Program, and (iii) be signed into his or her online account at the time of a certain purchase via the BRCC online service (e.g. website or mobile app) (“Service”). A customer enrolled in the Program is able to earn so-called “BRCC Loyalty Points” (or “Points”) and to reach certain Program Tiers (defined below) by making eligible purchases and/or taking certain other Program actions such as clearly indicated on the Service. Once a customer reaches a certain Tier in the Program and/or earns a certain number of Points, the customer may be eligible for certain benefits and rewards applicable to such Tier of the Program. BRCC is free to change the precise benefits of the Program from time to time and all rewards are offered on a limited basis as stated in the details of the Program and cannot be accumulated with other promotions or actions. Eligible purchases and other opportunities to reach certain Program Tiers or earn Points will be published on the Service or may be published through other media (e.g. in marketing communications, social media, etc.).
2.1. Eligible customers may only enroll in the Program by visiting the Service and after creating an online BRCC account (the “Account”) as specified on the Service. Each customer must be at least the age of majority in your state or province of residence to become eligible for the Program and to create a BRCC Account. All customers with an Account are automatically enrolled in the Program.
2.2. Customers are required to provide their email addresses and to create a password in order to enroll in the Program. Customers may also have the opportunity to provide us with their name, mailing address, birth date and mobile phone number, but such information is optional and such information may be used for promotional purposes and mailings. You can opt out of receiving certain promotional communications (emails or text messaging) from BRCC at any time by (i) for promotional emails, following the instructions provided in emails to click on the unsubscribe link, or if available by changing your communication preferences by logging onto your Account and (ii) for text messages, following the instructions provided in text messages from BRCC to text the word, “STOP.” If you opt-out of only certain communications, other subscription communications may continue. Even if you opt out of receiving promotional communications, BRCC may, subject to applicable law, continue to send you non-promotional communications, such as those about your account, transactions, servicing, or BRCC’s ongoing business relations. The BRCC Service may provide web pages or other mechanisms allowing customers to update his your information on the Service Unless otherwise provided for, no actual purchase is required to be enrolled in the Program. A customer holding an Account is referred to as a “BRCC Loyalty Program Member” or “Program Member.”
2.3. Each Account made up in the Program could only be associated with one single email address and one individual customer. In the event of a dispute over ownership of the Account, the customer will be deemed to be the authorized account holder of the email address submitted at the time of enrollment. For purposes of these Program Terms, the "authorized account holder" is the natural person who is assigned to the submitted email address by an internet provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Our Program only applies to customers of BRCC and is not part of any contractual relationship and does not constitute any contractual benefits. Rewards in the form of a discount code can therefore only be used on the Service.
- Earning BRCC Loyalty Points and Redeeming Rewards
Under the Program, you earn BRCC Loyalty Points by completing actions on the BRCC Service and by making online purchases of BRCC products. The Program consists of three “Tiers” in which you can complete actions. Subscription customers (in the BRCC Coffee Club or subscribed to another subscription product type) are considered to be in the highest Tier Program Members, and earn 5% Points back on purchases. Customers who spend $200 or more annually will also earn 5% Points back on purchases after they meet the spend criteria on previous orders. Non-subscription customers earn 1% Points back on purchases unless they meet the $200 or more annual spend to achieve a higher Tier.
Other activities can be completed to earn Points. These can be found in the customer portal online, along with details on the required activity and how many Points will be accrued for each one. BRCC reserves the right in its sole discretion to modify, change, add, or remove activities which can be accomplished to earn Points at any time.
Program Members may redeem rewards as they reach minimum thresholds per reward and in checkout. BRCC reserves the right to modify, change, add, or remove rewards and their Points thresholds at any time. Rewards are variable and can be applied during checkout. Program members may also receive access to unique products or other rewards. BRCC may choose to offer unique, exclusive rewards to various Program Tiers in its sole discretion.
BRCC Dealers are excluded from the Program. Dealers may not enroll or earn Points for purchases on BRCC products.
BRCC Loyalty Points will expire if there is no Account activity (i.e. if there is no new purchase made or order placed) in a period of twelve months. Rewards are non-changeable after redemption.
Rewards, benefits and/or Points earned through the Program have no cash value, are non-transferable (to third parties or to other platforms), and you have no property rights in or to rewards or other Program benefits. Points credited to your Account will be decreased or reversed, as applicable, if part or all of the purchase is returned or canceled or if the credit is obtained through fraudulent or other activity that violates these Program Terms. BRCC is not responsible for rewards, benefits and/or Points lost or redeemed due to fraudulent activity and is entitled to refuse the granting of any reward in cases of fraud or breach of contract on the customer’s part. The sale, barter, transfer, or assignment of any rewards or benefits offered through the Program, other than by BRCC, is expressly prohibited.
If a customer has concerns that a purchase or other activity was not properly assigned to his or hers Account, the customer may contact the BRCC Customer Service team by sending an email to firstname.lastname@example.org or by messaging BRCC via the chat button on our Service within a period of 45 days after the date the purchase or order concerned took place and by providing all relevant details and Account information. BRCC is not responsible for late notifications about purchases or other Program activities not being credited to an Account.
Rewards in the form of a discount are redeemable on your next online purchase with BRCC via the Service. You are required to redeem a discount during checkout of a specified order. Discounts are not valid for cash or cash equivalent and cannot be accumulated with other promotions or other contractual benefits offered, unless expressly stated otherwise. No adjustments can be made on previous purchases. A reward in the form of a discount is non-transferable. Offer subject to change, alteration, or termination by BRCC in its sole discretion at any time. Members are able to redeem no more than one discount per purchase/order. When Points are converted to a discount, that discount code will expire after 12 months if it is not used on a purchase in that timeframe.
- Changes, Termination And/Or Removal from the Program
BRCC may, in its sole discretion, alter, limit, or modify the Program rules, regulations, benefits, eligibility for Membership, or any other feature of the Program (including assigning any of its obligations to customers or Members under the Program at any time to another person or entity, without recourse) or may terminate the Program at any time and at its sole discretion, by posting any such changes on the BRCC Service or by communicating any changes via the contact details as provided for by the customer or Member via her or his Account.
As permitted by applicable law, BRCC reserves the right to exclude individuals from the Program at its own discretion. Any previously accrued Points by Dealers are subject to removal to account for Program changes as of March 2023. Any abuse of the Program, including failure to follow any Program Terms, Membership inactivity for more than 24 months, or any misrepresentation or conduct detrimental to the interests of BRCC, could result in a ban from the Program or could affect eligibility for any further participation in the Program. BRCC may terminate your Membership. Membership and Accounts are non-transferable and Membership purchases must be made on behalf of the Member. If Membership is terminated, revoked or otherwise canceled, any Points in your account will automatically become void and of no further value.
All Program design, text, graphics, logos, button icons, images, audio clips, the selection and arrangement thereof, and all proprietary software is property of BRCC and falls under the copyright of BRCC. The compilation of all Program content is the exclusive property of BRCC and protected by international copyright laws. Any use of Program materials - including reproduction, modification, distribution, republishing, transmission, display or performance - without the prior written permission of BRCC is strictly prohibited.
